Terms and Conditions

Fox Networks Group (UK) Limited, with offices at 10 Hammersmith Grove, London W6 7AP (referred to as “Provider“ or „we“ or „us“) organises on Instagram a contest regarding „One Strange Rock“ (hereinafter referred to as „Contest“). The Contest shall be subject to the following Terms and Conditions:

(1)       Participation

In order to participate the user uploads on Instagram under #OneStrangeRock one or more pictures owned by the user and featuring (solely) nature including without limitation animals. We shall be entitled to reject pictures which do not comply with the aforesaid requirements.

Each participant may submit one picture or more at his/her discretion.

Only persons who have reached the age of 18 years are eligible to participate. Employees of the Provider and/or of affiliated companies and/or their respective relatives and/or spouses shall be excluded from participation. 

(2)       Duration of the Contest

The Contest shall start on March 22^nd, 2018 and expire on December 31^st, 2018.In this time period pictures can be uploaded.

(3)       Publication of Picture(s)

During the Contest period, the best pictures may be published  on website and/or social media, newsletters and/or other internet presences of National Geographic (for details of our permitted use, please see the grant of rights clause below). The Provider will select such picture(s) at its free discretion. The Provider reserves the right to not publish any pictures.

(4)       Notification of Participants on Publication of Pictures

We shall be entitled to notify ,via a personal message on Instagram participants whose picture(s) are published by us. 

(5)       Publication of the Name of the Participant

We shall be entitled to publish the name of participants whose picture(s) we are using in connection with the publication of such picture(s). There shall however, be no obligation to publish the name of the participant.

(6)       Grant of Rights, Third Party Rights and Lawfulness

The user grants us the non-exclusive worldwide right, unlimited in time, to use the picture(s) made available by the user on internet presences of National Geographic like e.g. websites, social media and/or newsletters. We shall be entitled, in such context, to duplicate, publicly perform, adapt, modify, and/or sublicense the picture and/or use the picture for advertisement purposes.

The user guarantees that it is free to grant the aforesaid rights in the picture(s) and that no rights of third parties are thereby violated like e.g. copyrights, trademark or design rights or personality rights.

The user ensures that the picture(s) is/are lawful, e.g. that it is/ they are not in conflict with any applicable provisions of penal law.

(7)       No Relationship to Instagram

The Contest is not related to Instagram and is not sponsored, supported or organised by Instagram in any way. The recipient of the participating user's information is not Instagram but the Provider.

Questions, comments or complaints regarding this Contest must not be addressed to Instagram but to the Provider.

(8)       Liability

The Provider shall be liable for any damage that the participating user incurs through a grossly negligent behaviour or omission of the Provider or of a person assisting the Provider in the performance of the Provider's obligations hereunder or through a violation of essential contractual obligations of Provider (i.e. obligations the fulfilment of which is a prerequisite for performance of the Contest and which obligations the user generally expect to be complied with).  The aforesaid limitation of liability shall not apply to damages caused by the violation of life, body and/or health of the participant.

(9)       Cancellation of the Contest

The Provider reserves the right to cancel the Contest at any point of time without prior notice.

(10)    Exclusion of Participants

In case of violation of a provision of the present Terms and Conditions the Provider resevers the right to exclude the respective participant from the Contest.

(11)    Applicable Laws

The laws of Sweden shall apply.

Where the customer is a Consumer, such choice of law shall only apply to the extent that it does not affect mandatory provisions of the country where the customer has its habitual place of abode.

(12)    Data Protection

Where we collect the name of the participant in the context of the upload of the picture(s), we shall use such name, if at all, solely in context of the publication of the picture(s) in connection with the grant of rights hereunder.
